Money for War or Profit for the Aggressor? Court Issues Controversial Ruling on Payments to Russian Business

Amid unrelenting attacks on Ukrainian cities like Kyiv, Dnipro, Kharkiv, Odesa, Zaporizhzhia, and Sumy, as the country fiercely defends every inch of its territory, a Ukrainian court has issued a perplexing and controversial decision. The Pechersk Court in Kyiv has ordered Ukraine to return 2.6 billion hryvnias to a Russian company linked to the gambling industry, including the casino “PinUp.” This decision comes despite Russia’s status as an aggressor state and clear evidence that the funds were used to support terrorist activities against Ukraine.

Judge Olga Smyk of the Pechersk District Court not only ruled to return the seized funds to the Russian company but also mandated an additional 20% annual interest on the investment, securing the occupying owners an annual profit of 520 million hryvnias. These funds, which were expected to support Ukraine’s Armed Forces in their struggle against Russian aggression, are now effectively returned to the hands of the enemy.

According to documents, Judge Smyk immediately sent letters to banks following her ruling, demanding they unfreeze the funds and facilitate the rapid disbursement of payments. In a time when every hryvnia is critical to defense funding, this decision has sparked public outrage. Citizens are demanding an explanation from the judge, as hundreds of millions of hryvnias that could have been used for purchasing arms, drones, and other equipment may now become a profit for a company from an aggressor country.

Ukrainians tirelessly raise funds to support the military, buy vehicles for soldiers, and provide essential equipment to troops on the front lines. The court’s decision, which runs counter to the state’s interests, undermines the efforts of everyone contributing toward a victory. Many now question whether such practices should be allowed when any financial aid to the enemy erodes national defense.

International Reaction: Another Example of Pro-Russian Influence

This decision is sparking international discussion, highlighting how Russian legal and financial influence operates even in times of peace. For Ukraine, such judicial decisions raise questions about the independence of the judicial system, which, as this incident suggests, appears vulnerable to external pressures.
